Dog Bites

Strict Liability 

Because of the dangerous nature of dog bites, Missouri imposes a theory of strict liability toward dog bites.  Accordingly, the dog owner can still be held liable even if he or she did not have reason to believe the animal posed a threat or did everything in their ability to prevent the bite (e.g. - caged the dog, posted signs, or verbally warned about the behavior of the dog).  Therefore, victims must only establish (1) their injury was a result of the dog bite, (2) was injured on public property or lawfully on private property (i.e. - not trespassing), and (3) did not provoke the dog to bite.

Negligent Dog Owners

Dog related injuries not involving a dog bite (e.g. - dog jumping on someone, dog scratches, dog biting a bicycle wheel or chasing a bicyclist resulting in injury, etc.) are evaluated under the negligence standard.  Under a negligence theory, the victim's dog bite attorney must prove four interrelated elements: (1) the dog owner had a duty of care, (2) the dog owner violated this duty of care, (3) the violation of the duty of care was a cause of the injuries, and (4) the injuries sustained were physical.  If the attorney successfully proves each of these elements, the dog owner will be considered legally negligent, thus, obligated to compensate the victim for all injuries flowing for the incident.
